    <h1>Terms Of Service</h1>
    <p>Legal Note:</p>
    <p>In the following legal document Fsh refers to itself as fsh, us, we, our, or any plural designation, we may refer to the services and tools we offer as the Service and we may refer to user that agreed to the terms as you, user or any non plural designation.</p>

      <h2>1. Terms</h2>
      <p>Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, registered users, and others who wish to access or use the Service.</p>
      <p>By accessing or using the Service, you agree that you have read the terms and you are bound by these Terms. You also agree to be bound by our Privacy Policy at <a href="/pp" target="_blank">https://fsh.plus/pp</a> and incorporated here by reference.</p>
      <p>If you disagree with these Terms or Privacy Policy then you must not access the Service.</p>
      <h2>2. Acceptable Use of the Service</h2>
      <p>Your use of the Service is subject to the prohibitions on use and content in these Terms. If you are found to be in violation of these Terms or any of our other policies at any time, we may remove your access of the Service.</p>
      <h2>3. Prohibited Actions</h2>
      <p>In using the Service, you must not and may not allow any third party on your behalf to:</p>
      <p>a. Send, Upload, Distribute, or Disseminate to any unlawful, defamatory, harassing, abusive, fraudulent, infringing, or otherwise objectionable content;</p>
      <p>b. Distribute viruses, worms, defects, Trojan horses, or any other items of a destructive nature;</p>
      <p>c. Impersonate another person, public figure or company;</p>
      <p>d. Create or Register accounts with automation or in bulk;</p>
      <p>e. Transmit intellectual property or proprietary information illegally;</p>
      <p>f. Promote or Encourage illegal activity;</p>
      <p>g. Promote or Facilitate human trafficking, sex trafficking, physical abuse or any harmful action to a person;</p>
      <p>h. Interfere with, Disrupt, or Create an undue burden on the Service, networks or services connected to the Service;</p>
      <p>i. Attack or Tamper with other websites, services, and individuals;</p>
      <p>j. Collect or Harvest any personally identifiable information, including but not limited to account names from the Service;</p>
      <p>k. Use or Solicit the Service for any unauthorized commercial purposes;</p>
      <p>l. Rent, Lease, Loan, or Sell access to, or otherwise attempt to transfer any right from Fsh to a third-party;</p>
      <p>m. Engage in practices or activity with the purpose of which is to obtain lists of information, portions of a database, copy visuals, or business methods from the Service, in any manner and any quantities not authorized by Fsh in writing;</p>
      <p>n. Send unsolicited messages or use the Service to send unsolicited messages (also known as junk mail or SPAM);</p>
      <h2>4. Prohibited Content</h2>
      <p>You may not send, upload, transmit, or disseminate any of the types of content defined below on or through the Service:</p>
      <p>a. Content that infringes a third party's rights (e.g. copyright) according to applicable law;</p>
      <p>b. Excessively profane, Hate-related, violent, racial or ethnic intolerance content;</p>
      <p>c. Phishing or SPAM;</p>
      <p>d. Malicious content or content with destructive nature;</p>
      <p>e. Content that promotes or facilitates suicide or self-harm, including without limitation instructions or graphic images of suicide or self-harm;</p>
      <h2>5. Limits & Inactivity</h2>
      <p>Fsh imposes certain limits in using the Service, limits may be automatically enforced by the Service.</p>
      <p>Long periods of inactivity may result in your account or your use of the Service being deemed inactive. If you reside in the EU an inactive account will result on deletion of your data with previous notice as per the GDPR.</p>
      <h2>6. User Content</h2>
      <p>The Service allows you to upload, send, post, link, store, share, and otherwise make available certain information, code, text, graphics, videos, or other material ("User Content"). You fully control the type and nature of the User Content you upload, and as such you (and not Fsh) are responsible for it, including its legality, reliability, and appropriateness.</p>
      <p>By posting User Content on or through the Service, You represent and warrant that:</p>
      <p>a. The User Content is something you own and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms;</p>
      <p>b. That the posting of your User Content on or through the Service follows sections 3 and 4 of these terms;</p>
      <p>c. We reserve the right to terminate any account that is found to distribute or share infringing User Content;</p>
      <p>Any User Content you submit, post or display on or through the Service you are responsible for protecting the rights of the User Content. We take no responsibility and except where prohibited by law, we assume no liability for User Content you or any third party posts on or through the Service.</p>
      <p>By posting or uploading User Content using the Service you grant us the non-exclusive, worldwide, royalty-free, fully paid-up, sublicensable and transferable right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service in accordance with these Terms and our Privacy Policy. You agree that this license includes the right for us to make your User Content available to other users of the Service, who may also use your User Content subject to these Terms if necessary.</p>
      <p>Fsh has the right but not the obligation to monitor, edit, remove, or share User Content provided by users where it believes in good faith that it is necessary to comply with applicable law, to ensure the security of the Service.</p>
      <p>You may not distribute, modify, transmit, reuse, download, repost, copy, or use said User Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from the owner of such User Content.</p>
      <h2>7. Availability, Errors and Inaccuracies</h2>
      <p>We are constantly updating the Service offerings. There may be delays in updating information or advertising on other services. Service offerings may be discontinued, mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service.</p>
      <p>We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.</p>
      <h2>8. Notice and Communications</h2>
      <p>By creating an account on the Service, you agree that, from time to time, we may contact you (through discord or any other means) to notify you about certain changes or additions to the Service or regarding your use of the Service. In the event that a notice is not capable of delivering to you, any notices required by these Terms will nonetheless constitute effective notice. You may give us notice by contacting us using the links at the top of the document.</p>
      <h2>9. Account Termination Policy</h2>
      <p>You must be at least 13 years old to use the Service, or the applicable age in your country. However, a user under 13 may use the Service if enabled by a parent or legal guardian and permitted by the jurisdiction. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.</p>
      <p>If you are a parent or legal guardian of a user under the age of 18, by allowing your child to use the Service, you are subject to the Terms of this agreement and responsible for your child's activity on the Service and User Content they view.</p>
      <p>When you create an account on the Service, you represent that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.</p>

      <p>Fsh may terminate a user's access to the Service or remove User Content if in violation of these Terms or other policies, at any time, without prior notice or liability without limitation.</p>
      <p>In addition to the foregoing, we reserve the right to refuse service, terminate, or reclaim accounts and remove content at our sole discretion.</p>
      <p>If you wish to terminate your account, contact us using the links at the top of the document.</p>
      <p>All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.</p>
      <h2>10. Copyright Policy</h2>
      <p>We respect the intellectual property rights, we will respond to any claim that User Content posted on the Service that infringes on intellectual property rights of any person or entity.</p>
      <p>If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim to us using the links at the top of the document, include the line: "Copyright Infringement" and a detailed description of the alleged infringement.</p>
      <p>You will be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any User Content found on and/or through the Service on your copyright.</p>
      <p>If you break the copyright policy you may need to give us personal information of yourself in order to continue with legal proceeding.</p>
      <h2>11. Indemnification</h2>
      <p>You agree to defend, indemnify and hold harmless Fsh. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys' fees), resulting from or arising out of</p>
      <p>a. your use and access of the Service, by you or any person using your account;</p>
      <p>b. a breach of these Terms, or</p>
      <p>c. Content posted on the Service.</p>
      <h2>12. Links To Third Parties, Advertisements and Services</h2>
      <p>The Service may contain links to third party sites, advertisements, or services that are not owned or controlled by Fsh, including alongside your User Content or related to features of the Service.</p>
      <p>Fsh has no control over, and to the fullest extent permitted by law, assumes no responsibility for the content, privacy policy, or practices of any third-party web sites or services linked. We do not warrant the offerings of any of these entities/individuals or their sites.</p>
      <p>You acknowledge and agree that Fsh cannot and will not review, censor, endorse or edit the content of any third party site, advertisements, or services. Where the Service contains links to such third-party websites, advertisements, or services are only provided for your information and convenience.</p>
      <p>You acknowledge and agree that your use of any third-party websites, advertisements and/or services is at your own risk and that you should apply a suitable level of caution and discretion in accessing such links.</p>
      <p>When you leave the Service, the applicable third party's terms and policies apply, not these Terms.</p>
      <p>To the fullest extent permitted by law, by using the Service, you expressly relieve Fsh from any and all liability arising from your use of any third-party site, the Service, or advertisement and/or from your use of or access to any third-party content made available through the Service, including without limitation, any User Content made available or accessed through your interactions with other users of the Service.</p>
      <h2>13. Limitation of Liability</h2>
      <p>In no event shall Fsh, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.</p>
      <p>Fsh's total, cumulative liability for any claim, loss, or damage arising out of or relating to these terms will not be redeemed.</p>
      <p>By accepting the terms, you agree to waive your right to sue Fsh unless you first contact us to resolve the dispute using the links at the top of the document. This provision applies to all claims and disputes arising from your use of the Service.</p>
      <h2>14. Warranty Disclaimer</h2>
      <p>Your use of the Service is at your sole risk. To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.</p>
      <p>Fsh, its subsidiaries, affiliates, and its licensors do not warrant that</p>
      <p>a. The Service will function uninterrupted, be error-free, secure or available at any particular time or location;</p>
      <p>b. Any errors or defects will be corrected;</p>
      <p>c. The Service is free of viruses or other harmful components or content;</p>
      <p>d. The results of using the Service will meet your requirements;</p>
      <p>e. The Service and/or any content made available through the Service will be accurate or complete.</p>
      <p>Fsh assumes no liability or responsibility for any errors, mistakes, or inaccuracies of content, any personal injury or property damage of any nature whatsoever resulting from your access to or use of the Service, any unauthorized access to or use of the Service, any interruption or cessation of transmission to or from the Service, any bugs, harmful content, or the like which may be transmitted to or through the Service by any third party and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of the Service and/or any content posted, shared, transmitted, or otherwise made available via the Service.</p>
      <p>Some jurisdictions do not allow for limited liability or exclusion of implied warranties, so not all of the above limitations and/or warranty disclaimers may apply to you. You acknowledge and understand that the disclaimers, exclusions and limitations of liability set forth herein form an essential basis of the agreement between the parties hereto, that the parties have relied upon such disclaimers, exclusions and limitations of liability, and that absent such disclaimers, exclusions and limitation of liability, the terms and conditions of these Terms would be substantially different.</p>
      <h2>15. Governing Law</h2>
      <p>These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.</p>
      <p>Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding the Service, and supersede and replace any prior agreements we might have had between us regarding the Service.</p>
      <h2>16. Changes</h2>
      <p>We reserve the right, to modify or replace these Terms at any time.</p>
      <p>By continuing to access or use the Service or having an account in the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.</p>
